User Agreement

1.1. This User Agreement (hereinafter - Agreement) refers to the site «Shevchuk Photo», located at http://shevphoto.ru.
1.2. Website «Shevchuk Photo» (hereinafter - Site) is the property of a natural person (Shevchuk Julia Olegovna, registration address: Moscow, Russian Federation)
1.3. This Agreement regulates the relations between the «Shevchuk Photo» Site Administration (hereinafter - Site Administration) and the User of this Site.
1.4. The Administration of the Site reserves the right at any time to modify, add or delete paragraphs of this Agreement without informing the User.
1.5. Use of the Site by the User shall mean the acceptance of the Agreement and the amendments made to this Agreement.
1.6. The user shall be personally responsible for checking this Agreement for changes.

2.1. The following terms shall have the following meaning for the purposes of this Agreement:
2.1.1 «Shevchuk Photo» is an Internet resource located on the domain name http://shevphoto.ru, carrying out its activity through the Internet resource and related services (hereinafter - Site).
2.1.2. «Shevchuk Photo» is a website containing information about Goods and/or Services and/or Other Values for the User, Seller and/or Performer of Services, allowing to implement the selection, order and (or) purchase of Goods, and/or to receive the service.
2.1.3. Site Administration - authorized employees at Site Management, acting on behalf of the natural person Shevchuk Yulia Olegovna.
2.1.4. Website User (hereinafter - User) is a person who has access to the Site through the Internet and uses the Site.
2.1.5. Site content (hereinafter referred to as Content) - protected intellectual works, including literary texts, titles, preface, annotations, articles, illustrations, covers, music with or without text, graphics, text, photographic, derivatives, composite and other works, user interfaces, visual interfaces, trademark names, logos, computer programs, databases, and design, structure, selection, coordination, appearance, general style and layout of this Content, which forms part of the Site and other intellectual property objects all together and/or separately contained on the site http://shevphoto.ru.

3.1. The purpose of this Agreement is to provide the User with access to the Goods and/or Services provided on the Site.
3.1.1. The site provides the User with the following services (services): access to the site’s search and navigation facilities;
3.1.2. This Agreement covers all existing (functioning) services (services) of the Site at the moment, as well as any subsequent modifications thereof and additional services (services) appearing in the future.
3.2. Access to the site is free of charge.
3.3. This Agreement is a public offer. Upon access to the Site, the User shall be deemed to have acceded to this Agreement.
3.4. Use of materials and services of the Site is regulated by the norms of current legislation of the Russian Federation.

4.1. Site administration is entitled to:
4.1.1. Amend the Website Terms of Use and Contents. The changes shall enter into force when the new version of the Agreement is published on the Site.

4.2. The User has the right:
4.2.1. Use all the services available on the Site as well as purchase any Goods and/or Services offered on the Site.
4.2.2. Ask any questions related to site services:

4.2.3. Use the Site exclusively for the purposes and procedures provided for in the Agreement and not prohibited by the legislation of the Russian Federation.
4.2.5. Require the Administration to conceal any user information.

4.3. The User of the Site undertakes:
4.3.1. Do not use site information for commercial purposes without special permission.
4.3.2. Do not copy information from the Site.
4.3.3. Provide, upon request of the Site Administration, additional information that is directly related to the services of this Site.
4.3.4. Respect the property and non-property rights of authors and other rights holders when using the Site.
4.3.5. Do not take any action that may be considered to disrupt the normal operation of the Site.
4.3.6. Do not distribute using the Site any confidential and protected information about natural or legal persons.
4.3.7. Avoid any action that might violate the confidentiality of information protected by the legislation of the Russian Federation.
4.3.8. Do not use the Site to disseminate advertising information except with the consent of the Site Administration.
4.3.9. Do not use services to:
4.3.9.1. Violations of the rights of minors and (or) any form of harm to them.
4.3.9.2. Infringements of minority rights.
4.3.9.3. Presenting oneself as another person or representative of the organization and (or) the community without sufficient rights, including for the employees of this site.
4.3.9.4. Misrepresentations regarding the properties and characteristics of a Product and/or Service on the Site.
4.3.9.5. Incorrect comparison of Goods and/or Services, as well as negative attitude towards or conviction of persons (not) using certain Goods and/or Services.
4.3.10. Ensure the accuracy of information provided
4.3.11. Protect personal data from third-party access.

4.4. The user is prohibited from:
4.4.1. Use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy or monitor the contents of the Site.
4.4.2. Disrupt the proper functioning of the Site.
4.4.3. In any way, bypass the navigation structure of the Site in order to receive or attempt to obtain any information, documents or materials by any means not specially represented by the services of this Site.
4.4.4. Unauthorized access to the functions of the Site, any other systems or networks related to this Site, as well as any services offered on the Site.
4.4.5. Perform a reverse search, track or try to track any information about any other User of the Site.
4.4.6. To use the Site and its Contents for any purpose prohibited by the legislation of the Russian Federation, as well as to incite any illegal activity or other activity violating the rights of the Site or other persons.

5.1. The site and Content, which is part of the Site, belongs to and is managed by the Site Administration.
5.2. The contents of the Site are protected by copyright, trademark law, other intellectual property rights and unfair competition law.
5.3. This Agreement shall apply to all additional terms and conditions for the purchase of the Goods and/or the provision of services provided on the Site.
5.4. The information posted on the Site shall not be construed as a modification of this Agreement.
5.5. The Administration of the site has the right at any time without informing the User to make changes to the list of Goods and Services offered on the Site and (or) their prices.
5.6. The document referred to in paragraph 5.7.1 of this Agreement regulates in an appropriate part and extends to the use of the Site by the User.

5.8. Any of the documents listed in paragraph 5.7. of this Agreement may be updated. Changes take effect as soon as they are published on the Site.

6.1. Any damages that the User may incur in case of wilful or negligent violation of any provision of this Agreement, as well as unauthorized access to communications of another User, shall not be compensated by the Administration of the Site.
6.2. The administration of the site shall not be responsible for:
6.2.1. Delays or interruptions in the operation due to force majeure, as well as any failure in telecommunications, computer, electrical and other related systems.
6.2.2. Remittance systems, banks, payment systems and delays associated with them.
6.2.3. The proper functioning of the Site, if the User does not have the necessary technical means to use it, and has no obligation to provide users with such means.

7.1. The administration of the site has the right to disclose information about the User if the current legislation of the Russian Federation requires or permits such disclosure.
7.2. The Administration of the Site is entitled, without prior notice to the User, to terminate and (or) block access to the Site if the User has violated this Agreement or the Terms and Conditions of Use contained in other documents, as well as in case of termination of the Site or due to technical fault or problem.
7.3. The Administration of the Site shall not be liable to the User or to third parties for terminating access to the Site in the event of a breach by the User of any provision of this Agreement or other document containing the terms and conditions of use of the Site.

8.1. In the event of any disagreement or dispute between the Parties to this Agreement, the submission of a complaint (a written proposal for a voluntary settlement of the dispute) is a prerequisite before the application to the court.
8.2. The recipient of the claim shall, within 30 calendar days from the date of receipt of the claim, notify the claimant in writing of the results of the claim’s review.
8.3. If it is not possible to resolve the dispute voluntarily, any of the Parties shall be entitled to apply to the courts for the protection of their rights under the legislation in force in the Russian Federation.
8.4. Any action regarding the terms of use of the Site must be brought within 5 days after the cause of action has arisen, with the exception of copyright protection of protected materials of the Site. If the terms of this paragraph are violated, any action shall be dismissed by the court.

9.1. The Administration of the site does not accept counteroffers from the User regarding changes of this User Agreement.
9.2. User reviews posted on the Site are not confidential information and may be used by the Site Administration without restrictions.
